A growing number of states have passed laws restricting how children and teenagers use social media, setting up an escalating legal battle over age verification, parental consent, and where the line between child protection and free speech actually sits.

State lawmakers have introduced a wave of legislation targeting minors’ access to social media platforms.

A wave of state legislation aimed at restricting minors’ access to social media has passed in recent years, driven by growing concern over documented links between heavy social media use and adolescent mental health, and frustration that federal action on the issue has stalled despite years of congressional hearings and proposed bills.

These state laws vary considerably in approach, from requiring parental consent for minors to create accounts, to mandating specific age verification technology, to restricting certain platform features like algorithmic recommendation feeds for underage users. Several have already faced legal challenges from industry groups and civil liberties organizations arguing the laws burden protected speech or create privacy risks through the verification systems they require.

Courts are still working out where the line sits

Early court rulings on these laws have been mixed, with some provisions upheld and others blocked, reflecting genuine legal uncertainty about how to balance child protection goals against speech and privacy concerns raised by age verification requirements that, in some designs, would require adult users to submit identification just to access ordinary platform features.
